Absolute German official terms and conditions:

* PURCHASE PRICE Unless otherwise agreed in writing, Buyer shall pay in good funds to Absolute German, at the time an order is placed, the purchase price for such Parts as depicted on the invoice together with state, county, and local sales tax and all shipping costs.

* ENGINES AND TRANSMISSIONS Absolute German warrants all engines for 30 days from sale against knocks and cracks in heads and blocks. Any motor cylinder head with a melted heat tab is sold “as is, with all faults”. Except as otherwise provided below, Absolute German warrants all transmissions, transaxles, and differentials for 30 days from sale to work properly without excessive noise. Absolute German recommends new oil seals and gaskets before installation of engines, transmissions, transaxles, and differentials. Absolute German does not warrant against oil consumption, oil leaks, other normal wear and tear, emission levels, seals, gas leaks, oil pumps, water pumps, belts, hoses, bolts, tightness of bolts, and accessories if sold with engine and warranty.

* CORES All Identified Parts having a core value are sold on an “exchange” basis and require a core deposit. All cores shall be returned, drained of oil, within 20 days from sale for a refund of core deposit. All cores must be the same type of part as that sold. Exchange parts must be turned in at time of purchase or a core deposit must be made. The core deposit will be refunded when the core is returned and must be accompanied by the original invoice.

* ALL OTHER PARTS Except as otherwise provided in writing from Absolute German, Absolute German warrants all Parts for 30 days from sale to work properly. Cut off body parts, glass, emissions equipment, electrical parts, brake parts, and safety equipment, such as air bags and charged seat belts have no warranty unless noted on front of invoice and are sold “as is”. Because the conditions of use are beyond Absolute German’s control, Absolute German assumes no obligation or liability for the performance of these articles. Buyers must establish for themselves whether these articles
are suitable for their use. Absolute German will not warranty and shall not be responsible for any Parts which have been altered, modified, disassembled, or damaged subsequent to the sale.

* SHIPPING In the event that the Buyer receives a package with any damage either noticeable (outside) or concealed (inside); it is the responsibility of the Buyer to note any damage upon receipt of package and file a claim with carrier.

* RETURNS Buyer shall return to Absolute German any defective Identified Part and a copy of the invoice within 30 days of the date on the invoice for said Part(s). Subject to availability, Absolute German will replace or repair the defective Identified Part with another part from inventory, or purchase the Identified Part from another source. Absolute German will not refund cash. If Buyer purchases an Identified Part in error, the Identified Part may be returned for a restocking fee equal to 25% of the purchase price. The balance of the purchase price will be given to the Buyer as an “in-house credit” to be used to purchase any Identified Part in the future. No reimbursements will be given for delay, labor, mileage, or any other costs in connection with installing, or reinstalling an Identified Part.

* DISCLAIMER Except as expressly provided herein, Absolute German hereby expressly disclaims all warranties, both express and implied, including any implied warranty of merchantability or fitness for a particular purpose. Absolute German makes no warranties against loss caused from installation, removal, or repair. Used merchandise sold may have safety hazards, and it is the sole responsibility of the Buyer to inspect for actual or latent safety hazards.

* REPLACEMENT OR USE OF THE PARTS Any warranty, as provided herein, is void if Identified Parts have been abused, disassembled, altered, used off-road, or for racing purposes, run without proper lubrication, overheated, or improperly installed. Absolute German is not responsible for improper installation or usage after sale. Any warranty, as provided herein, begins on date of sale, as depicted on the invoice, regardless of when an Identified Part was installed, used, or shipped.
Absolute German is not liable for and Buyer waives all claims for safety hazards and consequential damages which result from the sale of the parts, loss of income, towing, wages or car rental charges, transportation or shipping costs to return the Identified Part or any other costs incurred to the Buyer. The warranties provided herein shall run only to the Buyer and no assignees or successors of the Buyer. The warranties provided herein give the Buyer specific legal rights, and it may have other rights which vary from state to state. The total liability of Absolute German hereunder shall not exceed the purchase price of the Parts actually sold.
